Ray Vandenberg is the managing partner of Vandenberg & Feliu, LLP and heads the firm’s Litigation Department. His practice concentrates on complex commercial and corporate litigation. Mr. Vandenberg began his legal career at Thacher, Proffitt & Wood and was a partner at Finley, Kumble, Wagner in New York City. He was also president of a company in the hospitality service industry for several years before founding the predecessor to Vandenberg & Feliu in 1991.
During his 30-year legal career, he has litigated hundreds of cases, many of which have gone to trial, including commercial contract disputes, fiduciary breaches, estate and receivership accountings, securities fraud, RICO, securitized mortgages, ERISA, restrictive covenants, international banking disputes, corporate governance disputes, minority shareholder disputes, partnership disputes, real estate, cooperative and condominium law, and bankruptcy matters. He has litigated in state and federal trial and appellate courts throughout the U.S. He has also represented parties in numerous arbitrations before the AAA, JAMS, and various financial industry arbitration panels, and has also represented clients before the NLRB.
Recent cases include multiple lawsuits and commercial arbitrations arising from the sale of an international business, construction fraud at a major airport, avoiding an injunction concerning computer source code, defending a CMBS depositor against allegations of breaches of representations and warranties by the trustee of a pool of securitized loans, obtaining injunctive relief on behalf of ERISA health plans to enforce their subrogation rights, enjoining the immediate seizure of a New York bank account to satisfy a foreign arbitration award, and successfully defending the general partners of several limited partnerships sued for fraud and civil violations of the Racketeering Influenced and Corrupt Organizations Act (“RICO”) resulting in dismissals or abandonment of the cases by the plaintiffs, and, in one case, an award of attorneys’ fees to the defendants. He has also represented numerous employers sued under federal, state, and local employment discrimination statutes, and has represented management in labor disputes with their unionized employees.
Mr. Vandenberg is married with two children and lives in Pelham Manor, New York, where he is the Village Attorney and the former chairman of the Village Planning Board. He is active in youth sports programs and is an avid runner. He is a trustee of The Joyce Theater in New York City and a member of the Lincoln Center Business Council. He was co-chair of the Vestry and the Chancellor of St. Bartholomew’s Church in New York City. He has undertaken many pro bono matters on behalf of the church, including the landmark case before the Second Circuit and the U.S. Supreme Court. From 2007 to 2010, Mr. Vandenberg was Presiding Judge of the Ecclesiastical Court of the Diocese of New York. In 2010, he was appointed by the Bishop of New York as Vice Chancellor of the Diocese. Mr. Vandenberg is also a member of the Council on Judicial Administration of the Association of the Bar of the City of New York.
